The Supreme Court recently, in its judgement said that Pharmacy Council and State Government should check on the hospitals and medical stores which are not run by the fake pharmacist and run by the registered pharmacists only.
The Hon’ble Court said that “Running the hospitals/dispensaries in absence of any registered pharmacist and/or running such hospitals by fake pharmacist and even running the medical stores by fake pharmacist and without even any pharmacist will ultimately affect the health of the citizen”.
This was observed when the Hon’ble Supreme Court, restored a Public Interest Litigation that was before the Hon’ble Patna High Court.
The Petitioner, said that the Clerks, Nurses and other staff has been assigned with the duty to check on the registered Pharmacists, but the Petition was disposed of by the Hon’ble High Court on the ground that a fact finding committee’s report had already been forwarded to the State Government.
It is obviously risky and wrong to be playing with the life of the patients, their families, and citizens in general as the same would make them lose faith not only in the medical field of the country but also lose their loved ones if they are not being treated properly, attentively and with the correct medication.
The Hon’ble Supreme Court directed the State of Bihar and Bihar State Pharmacy Council to check on the same and take the right actions on the ones who have not been acting legally, while also checking the Pharmacy Practice Regulations, 2015 are being followed in the whole State of Bihar or not.
The Hon’ble Supreme Court has been aggrieved and dissatisfied with the impugned order of the Hon’ble Patna High Court. I think the same is rightly done as there should be no compromise on the health care facilities of the citizens, especially when the country has faced COVID-19 and has seen how important the whole medical sector is and how doctors are given the position of nothing less than God.
When the citizens lose their faith in such a pious profession, then where will they put their faith in? Such a thing could not and should not be taken casually. The Pharmacy Act, 1948 as well as the above stated Practice Regulations should be put to their proper legal implementation.
In my view the same is the most important issue in the date and time we are living in. The health of every citizen is important, be it anyone, as in Article 21, the right to life. Nobody should have to face the loss, the grievous harm that the fake medicines can provide to them or their loved ones, especially after seeking the situation that has been faced in the COVID-19 phase, that came all over the world.
